1. Artistic Style and Expectations
Client acknowledges that Ethan Sleeper’s portfolio and website accurately represent his photographic and editing style. By booking a session, the Client agrees to engage the Photographer based on that style and grants full artistic discretion in decisions involving lighting, composition, color balance, posing, and retouching.
Photography is a creative medium; therefore, minor variations in appearance (such as skin tone, texture, or perceived brightness) are natural and may differ from how subjects appear in person or on phone cameras. These variations do not constitute grounds for refund or rework.
2. Client Preparation and Session Conduct
Clients are responsible for arriving on time, prepared, and with all agreed-upon outfits or props. Any delays, missed items, or last-minute changes that affect the shoot may reduce shooting time or image variety without entitlement to additional time or refunds.
The Photographer will provide direction and feedback during the session to ensure flattering poses and lighting. Cooperation and clear communication during the shoot are expected to achieve the best possible results.
3. Image Selection, Editing, and Delivery
The Photographer will capture and review all images taken during the session and deliver a curated, edited gallery consistent with the selected package. The Client understands that not all images captured will be delivered and that final image selection and editing style are determined by the Photographer unless otherwise specified in writing prior to the session.
Edited images are delivered in high-resolution digital format via an online gallery. Raw or unedited files are not included in any package unless explicitly agreed upon in writing for an additional fee.
4. Post-Production and Adjustments
The Photographer applies professional editing to enhance tone, color, lighting, and overall quality in line with his artistic style. The Client may request minor color or brightness adjustments within 7 days of delivery. Requests for extensive retouching (such as body modification, object removal, or significant stylistic re-edits) may be completed for an additional fee at the Photographer’s discretion.
5. Turnaround Times
Estimated delivery timelines are provided at booking but may vary depending on workload, season, and project scope. Clients will be notified of any significant delay. Expedited delivery may be available upon request for an additional fee.
6. Refunds, Cancellations, and Reshoots
Due to the personalized and creative nature of photography, all payments are non-refundable once the session has taken place and the gallery has been delivered. Refunds are only provided if the Photographer is unable to complete the session due to illness, emergency, or other unforeseen circumstances beyond his control.
In cases of dissatisfaction, the Photographer may, at his sole discretion, offer additional editing, a discounted reshoot, or a partial goodwill refund. Such gestures are voluntary and do not alter the terms of this agreement.
If the Client cancels a session with less than 48 hours’ notice, the deposit or retainer fee is forfeited. Reshoots requested by the Client for reasons unrelated to technical error (e.g., styling preferences, posing choices, or personal appearance) are treated as new sessions and billed accordingly.
7. Rescheduling Policy
Clients may reschedule once without penalty if notice is provided at least 48 hours in advance. Short-notice reschedules or repeated changes may incur a rescheduling fee. Weather-related reschedules are at the Photographer’s discretion and will not incur a fee if safety or quality is at risk.
8. Copyright and Usage Rights
All photographs remain the copyright of Ethan Sleeper. The Client receives personal usage rights for digital and print use, including social media, dating profiles, and personal websites. Commercial use (e.g., advertising, brand promotion, or resale) requires written permission and may involve a licensing fee.
The Photographer reserves the right to use images for portfolio, website, social media, and marketing purposes unless the Client explicitly requests otherwise in writing before the shoot.
9. Liability
The Photographer is not liable for circumstances beyond his control, including but not limited to weather, lighting conditions, client tardiness, wardrobe issues, or uncooperative behavior. Liability for any claim shall not exceed the total amount paid for the session.
10. Agreement and Acknowledgment
By booking and submitting payment, the Client acknowledges that they have read, understood, and agreed to the terms outlined above. This agreement ensures clarity and mutual respect, allowing both parties to collaborate effectively and creatively.
